Because, it's on the books as law doesn't make it just. You're not wrong in thinking this way. In a perfect world parents would be able to raise their kids without the involvement of the courts. But this is not a perfect world. Sometimes the courts are a neccesary evil in order to get things done. As a man you don't want to have to depend on a woman for anything outside of being a partner, friend and wife. But if you've exhausted all other options then sometimes the court may seem like a viable route.
