It should be whatever the penalty is for perjury, obstruction of justice, or making a false statement to police.

Basically, we already have laws on the books that would cover a false rape accusation............the problem is that those laws are rarely enforced within that context.

And, unfortunately, there needs to be some distinction between a false rape accusation.........and someone who intentionally lies about being raped.

Just because someone makes a false rape accusation, it doesn't necessarily mean they are intentionally lying.

Meaning, the way a lot of these laws are set up............there are some women who might actually feel like they were raped, when........in fact......it's only a situation in which they regret having had sex with someone.

I think @konceptjones referred to it as "regret rape."

I think most women would actually pretty much agree with harsh penalties for false accusers. Reason being is those who actually report, or even those who merely TELL someone, usually get met with a lot of speculation and side eyes to begin with. To have broads out here LYIN about the shit, even IF it is a "regret rape" (dope term to whoever coined it), only serves to intensify the doubt and scrutiny that FOR REAL victims gotta go through. I mean shit, at any given moment, any woman...or their DAUGHTER can be assaulted. If they got any wits about themselves, they BETTER want false accusers to be penalized so if they or anyone they're close to is ever so unfortunate, they'll be less likely to have to go through the bullshit.

Back in college this cat hooked up with this hoe after a party. Both of them drunk as fuck. They do that genital bonding.

The next day my boy is woken up by the cops who arrest him for rape. Homegirl turned him in saying she was "drunk" and didn't remember saying yes. My nigga then sez "yo I was drunk too. Blacked out. I don't remember shit" which was the truth as several neutral witnesses attested to.

They still hit homie with a charge and a 6 month suspension tho claiming that because he was able to get an erection he was in fuller control of his faculties. I guess her creamy pussy didn't count.

He got the criminal shit dropped with the quickness in an actual court of law but had to threaten the College with that lawsuit to get that suspension revoked.

Sometimes, they just come clean on their own. If they felt like they'd be punished, they might not do that, and more innocent men would wind up remaining in jail.

First of all, the idea of some random deplorable lying on a man about something as serious as a rape to me is discust on so many levels.

But with that said, rape is not so cut and dry so i kind of agree.

I think you would have to undergo a second trial to prove beyond a reasonable doubt that the chick in question

Yeah this is an issue that would need to be addressed. If a man is acquitted but it's one of those "You're found not guilty in a court of law but we still know you did some shit" then how would that work?
