Second one I haz no clue. Few months ago there was a case discussed where a lady with cerebral palsy was 'raped' but the accused was not convicted and walked because she did not put up 'adequate struggle' to indicate the sex was not consensual.

Eh, I've read plenty of women on here do that not only without repercussion but are lauded for their efforts lol.

I think your scenario is slightly different than "typical" rape in that the male isn't penetrated (but still violated if he feels that way). Nor have I ever heard a male complain of such..events. Conversely, if for whatever reason he did not want the offered fellatio, then the woman must accept the no or face potential consequences.

As for the second scenario ?? If you can feel someone doesn't want to fuck you...common sense would dictate you stop imo. Why fuck someone who is clearly uncomfortable. Also, if at any point she says no or wants you to stop..you stop. Do not pass Go, do not collect a roofie, do not ask questions. Pull out and stop.

I'm gonna go out on a limb and say yes to both "by definition" given that there was no verbal consent in both scenarios.

But I guess it would be up to the husband to make it be known that he didn't comply, similarly with the woman in the second scenario.

Rape can be complicated it aint as simple as yes and no. Woman have the power to destroy a mans life just by the accusation alone. If a girl drinks too much fucks a stranger wakes up and regrets it " oh he raped me". They use it as a tool to get revenge on ex boyfriends, husbands etc. it's pretty hard to disprove a rape because even with consensual sex the physical evidence is still there. Rape in 2013 is tool used against men to show power. I'm sure there are legitimate rapes but Lets not forget that woman can be spiteful.
