Some people want this to fall under the category of rape. I'm not sure that makes sense as it differentiates protected and unprotected sex in a way that, in my view, should not happen. Protection falls along 2 lines: protection from pregnancy and protection from STD. If some kind of prevention against 1 of these is all that is required to constitute "protection", then any woman who claims to be on Birth Control but is not would also be guilty of this kind of "rape". Which does not make sense to me.
