it just wasn't possible to prove Dunn went to store for the sole purpose & intent of killing Jordan.

He was attempting to kill the other kids, that's why he was found guilty on attempted 2nd degree murder

It was murder because his life was not in danger, he went back to his car than went back to shoot. He made a conscious decision to kill someone which he did.

Yeah but the judge throwing that in just caused more confusion. You are asking 12 people who are not well versed in law and come with their own prejudices to decide not only if Dunn is guilty of 1st degree murder and if not then come to a consensus on 2nd degree or manslaughter. Too many options means a greater chance of a mistrial. Of the 2 jurors that have come out already one has thought that Dunn was guilty of first degree and one thought he was guilty of second degree.

Also Dunn was initially charged with 2nd degree attempted murder and 2nd degree murder. Then later the murder charge was upgraded to 1st degree, but the attempted murder charges stayed the same. You see what he got convicted of...

Since they went with second degree attempted they should have went with second degree murder.
