Reading this shit is frustrating. This dude had several opportunities to man up and report things he felt were problematic (the kicks and being uncomfortable w/ Evans b/c of her demeanor and approach), but he always gives an excuse about why he didn't bring things to light.

As far as the injuries to Gettler, the guy is schizo and demented and sometimes unresponsive according to his father. Based on how things played out he was somewhat unresponsive at the hotel when cops approached. After that scuffle it seems reasonable to believe that this guy wouldn't properly make a complaint about the kicks or excessive force at that time. He's already a nut case and he just got shocked with a taser while he wrestled a cop.

This justification they make in the Decision of the Board is kinda ill:

"Although Richard Gettler’s testimony supported appellant’s assertion that Sergeant Evans kicked Gettler, the Board found his testimony not credible because it was inconsistent with his son’s testimony."

They came to that conclusion even though they said this:

"The Board brought Gettler in to question him during the administrative hearing, but his responses generally were incoherent and nonresponsive."

In the end, being SHOOKED bit him in the ass:

"The Board found that appellant had failed to report the alleged kicks, despite numerous opportunities to do so, and that his testimony regarding his reasons for not reporting the kicks was not credible."

This is what being a scary nigga trying to keep things peaceful when you know shit ain't right gets you. They systematically took his balls from him over time, which lead to him second and third guessing whether or not he should bring legitimate issues to light.

Lol @ how the were able to stick him with this shit. All that floundering and you finally decide to report the kicks the day after a fairly unfavorable weekly evaluation was submitted:
