But don't they have to prove intent ? I always thought that trying to prove intent was one of the most difficult things for a lawyer to prove since one can use the presence of fear and not being mentally sound to make a sound judgement.....

Generally speaking yes, this would be harder to prove if troy was swinging a baseball bat rather than shooting a gun. In cases where people are shooting into a crowd, it's pretty much a given intent was to kill...
