Assholes. But not something they should be charged for.

I wouldn't save a cop or a racist (against Blacks) person .... AND I would've gladly posted that shit online. Fuck the outrage.

Criminal Negligence

The degree of culpability is determined by applying a reasonable person standard. Criminal negligence becomes "gross" when the failure to foresee involves a "wanton disregard for human life" (see the discussion in corporate manslaughter).

The maximum penalties for criminal negligence causing bodily harm and death are 10 years (14 years if the conviction is for street racing causing bodily harm) and life imprisonment, respectively.

IMO they could be charged with Criminal Negligence for not calling 911. Their family lost all contact of the victim and had gone days without seeing him. They (the family) reported him "missing". If the teens had called 911 at least the family would have known what happened to him.

What the fuck is "failure to foresee" anyway ? Shit don't even make no sense the way these laws are written. I will never agree with some law that holds someone responsible for seeing some shit they have nothing to do with and not doing something about it.

Especially when the law is so unequally applied to segments of the population. For instance that same law could be applied to all the partners of cops who murdered people, never did anything to help the situation, and never got charged - though 100% sure they would've got off anyway.
 
Reminds me of the alleged backstory for Phil Collin's "In The Air Tonight".

Sounded like it was all fun and games to them til they realized he wasn't coming back up.

They won't be charged. CNN confirmed this. Can't arrest someone for being an asshole.
 
Beyond fucked up. But there's no duty to rescue in most states and I believe in Fla the good Samaritan statue simply removes liability for a rescue attempt gone awry.

1L year my both Torts and Criminal law classes discussed the Sherrice Iverson case. I don't know if anyone here is familiar with it. 20 years ago in a Vegas casino, a teenager raped a little black girl in a bathroom stall. He was charged and convicted and is still incarcerated (got life). His friend, David Cash Jr, "witnessed" (I believe, as do many others that he was a part of the crime, acting as a lookout) the crime and didn't report it, get a security guard, try to assist the little girl, nothing. His defense was that he had no obligation, legal or moral to help someone he didn't know.

He wasn't charged because at the time Nevada had no laws requiring bystanders to report crimes. Nevada passed a bill in 2000 requiring notification of law enforcement if a person suspects a minor is being sexually assaulted. California passed a similar law as well.

I don't know if FLA will do the same, but these kids could have called 911 for a paramedic and left instead of sitting and filming someone drowning...

I wanna say it's the bystander effect aside for the fact that they were seemingly entertained and experiences some enjoyment. With the bystander effect, people freeze, go into shock, or they get scared to get involved, or they expect that someone else will get involved so they don't have to.

They would have had to endanger themselves in order to help him. Its different from seeing someone choking or something like that. I don't believe they should be charged.

They should be ridiculed and shamed for thinking its funny and recording it but charged? Nah.

After he drowned they walked away and continue to smoke weed.

His family reported him missing for 3 days
 
Them kids ain't shit for not calling for help, but that's as far as I'm going with it.

He reportedly dragged himself there, knowing he couldn't swim? Why should someone risk their life for a dipshit who was probably suicidal from the jump?

Let's these kids are heartless for not even bothering to notify anyone, but let's put personal responsibility where it belongs, too.

Dude shouldn't have been considered a "bystander" if he was acting as a lookout.

Lets get something straight; Those teens had no obligation to jump in the water and try to save him, unless they were trained, licensed lifeguards. In fact, even if they were trained licensed lifeguards, unless they were ON DUTY, they had no obligation to jump in the water and try to save them.

But I feel that its Criminal Negligence because they watched a man drown and didn't call 911.

I understand that they weren't trained and didn't know how to save him (I'd bet most of the posters on the IC don't know how to save somebody from drowning) But all they had to do is call the police and tell them what happened.

We get it, they couldn't save him. Nonetheless, they could have called 9-1-1, and maybe they wouldn't have gotten there in time, but his poor family wouldn't be wondering what happened to this man for THREE sleepless days.

On another note, a dude I went to high school with was mentally disabled and went out like this a few years back, not sure what it is about the water, but I am guessing this man said fuck it, I'm killing myself in a fit of rage and by the time he became lucid again, it was too late. RIP.
