Yes she definitely is. The girl taped the security monitor with her cell phone, then shopped it around to like 5 different sources. She did it all wrong.

Now if it just so happened that someone jacked her for her cell phone while she was in Zumba class at Planet Fitness * Kanye shrug* The hotel would have been assed out. She didn't steal the actual tape, didn't release it. At most she would've gotten fired for taping it but would still be 250k richer. Clearly she didn't plan this out very well.

how would she be able to claim to her phone lost/stolen and at the same time still claimed the loot?

It wouldn't be "stolen" by a stranger, but by someone she trusts. They have no obligation to that hotel since they aren't an employee. Then that person sells it to some equally unethical organization who is going to pay for it no questions asked. Its not like they need confirmation that it's valid. Clearly it's Jay, Bey, and Solange in the video. Total anonymity, take the money and go. When and only IF the hotel eventually fingers the girl, she can truthfully say her phone was stolen.

Shed have to kick down a small chunk to the "thief" though.

Its a corporation and the employee likely signed a contract.

I doubt the contract excluded a clause that says they wont record anything and they'd take steps to make sure nothing left the confines of the security office or whatever.

If you know anything about corporations and law in general. They're gonna get your ass some kind of way. It's somewhere in the fine print and a lot of that money is going straight to her lawyer, bail, and court costs.

Because even if there is a finding of not guilty (there will likely be a plea deal). Each hour in court is gonna cost. Plus, the government is gonna want some of that money too because it might count as income.

So yeah she shuld have done some research first like you said. The "my phone was stolen/my friend took it" wouldnt hold up with a jury.

In an exclusive statement to The Associated Press on Thursday, the trio said they have worked through their differences and moved on since a video emerged this week showing Solange kicking Jay Z as Beyonce looked on.

"As a result of the public release of the elevator security footage from Monday, May 5th, there has been a great deal of speculation about what triggered the unfortunate incident. But the most important thing is that our family has worked through it," the statement said. "Jay and Solange each assume their share of responsibility for what has occurred. They both acknowledge their role in this private matter that has played out in the public. They both have apologized to each other and we have moved forward as a united family."

It was the first comment the performers had made since the website TMZ posted the three-minute video on Monday, saying it was shot last week inside the Standard Hotel in New York City. The video, which does not have audio, appears to show Solange attacking Jay Z in Beyonce's presence; a security guard intervenes. The footage shows the performers in the outfits they wore to the Met Gala.

"The reports of Solange being intoxicated or displaying erratic behavior throughout that evening are simply false," the statement continued. "At the end of the day families have problems and we're no different. We love each other and above all we are family. We've put this behind us and hope everyone else will do the same."

The hotel said Wednesday it had fired the person who recorded the video.
 
It would only go to trial if she wanted to fight it, which wouldn't be smart either. Besides that, neither the DA nor the hotel wants to spend thousands in legal fees if they can get her to agree to punitive damages (which wouldn't be anywhere near 250k just for the act of taping). On top of that, this type of case is highly unlikely to be heard before a jury.

And all this is only based on the assumption that the hotel found out it was her in some way other than the fact that she sold the video herself.
 
Regardless if she had went with the the "stolen phone" angle

It all would have led back to her,one way or another,sooner or later.

Simple questions would have placed her directly/indirectly under suspicion:

What time did this incident happen?

Who was on duty at the time?

What time did they clock in for work?

What time they clocked out?

Who is suddenly requesting extended vacation time?

Is that a S-Class?

On your salary?

It is bad pr. I mean just come out and admit you got caught slippin. None of them knew a camera was in that elevator if they did none of that would've happened. Come on out and explain what happened, they all look bad no matter what they do at this point anyway.
