I just looked at the statutes, attempted murder is probably an overcharge. The problem is that the victim drove away and then turned around then ran the dude down, versus the stick up kid getting ran over during the robbery if the victim was trying to pull off. They might try to get him on some depraved indifference to life or recklessly engaging in conduct which creates a risk in death of another person.
