Here are the numbers:
31 states have the age of consent at 16.
8 states have the age of consent at 17.
11 states have the age of consent at 18.
So, a 14 year old with a 17/18 year old is illegal across the board. 30 states have Romeo and Juliet laws on the books but in many instances a 17 year old having sex with a 14 year old is still illegal and an 18 year old is definitely illegal. Being one of those states, Texas requires that the younger of the two is over the age of 14 at the time and the older person no more than 3 years older than the "victim". In this case it fails the test because the younger person is 14 so the act is still statutory rape.
A 13 year old having sex with a 15 or 16 year old is most definitely defined as statutory rape. The problem is that when it's a 13 year old and 15 year old, both are guilty of the same crime and, in fact, can both be prosecuted for it.
